States Sue Obama Administration Over Transgender Bathroom Policy

AUSTIN, Tex. — The Obama administration on Wednesday faced the first major court challenge to its guidance about the civil rights of transgender students in public schools, as officials from 11 states filed a lawsuit testing both the scope of federal anti-discrimination law and the government’s sweeping interpretation of it.

The officials, in states from Arizona to Georgia to Texas to Wisconsin, brought the case in Federal District Court in Wichita Falls, Tex., and said that the Obama administration had “conspired to turn workplaces and educational settings across the country into laboratories for a massive social experiment, flouting the democratic process, and running roughshod over common-sense policies protecting children and basic privacy rights.”

The lawsuit asked the court to block the federal government from “implementing, applying or enforcing the new rules, regulations and guidance interpretations.”

North Carolina governor signs controversial LGBT bill

House Bill 2, the Public Facilities Privacy & Security Act, puts in place a statewide policy that bans individuals from using public bathrooms that do not correspond to their biological sex. The bill also reserves the right to pass nondiscrimination legislation to the state government, saying state laws preempt any local ordinances.

Pat McCrory, a Republican, signed the bill Wednesday night and tweeted, “Ordinance defied common sense, allowing men to use women’s bathroom/locker room for instance. That’s why I signed bipartisan bill to stop it.”

The General Assembly went into special session earlier in the day to push through the legislation, a response to a nondiscrimination ordinance that the city of Charlotte enacted that, among other things, made it possible for transgender individuals to use the public bathroom of the sex they identify as.

  • MacManus did not respond to a request for comment, but he updated his LInkedIn in July to say he was now at Apple.
